An important meeting of the Election Commission of Pakistan (ECP) was held under the chairmanship of Chief Election Commissioner Sikander Sultan Raja.
The meeting was attended by ECP members, the Secretary, and the legal team, which provided a briefing on the Supreme Court's clarification.
According to sources, the Election Commission decided to continue consultations, and another advisory meeting will be held on Thursday.
It is noteworthy that the eight-member bench of the Supreme Court issued a clarification on September 14 regarding the reserved seats case. The clarification stated that, in light of the decision, PTI candidates who submitted party certificates are successful, and the Election Commission must immediately implement the decision.
The majority eight-judge bench's decision, spanning four pages, stated that the Election Commission had approached the Supreme Court for clarification regarding 41 members. The Commission's request for clarification was deemed an attempt to create confusion and a delaying tactic. The request for clarification was seen as an obstruction to implementing the court's decision and was not considered valid.
The Supreme Court's clarification order noted that the Election Commission had itself recognized Barrister Gohar as the party chairman. The Commission's acknowledged position is that PTI is a registered political party, and even dissenting judges recognized PTI's legal position.
The written order stated that the Election Commission cannot alter its position under the guise of clarification. According to the decision, PTI candidates who submitted party certificates are successful, and the Supreme Court's July 12 decision is clear and applicable to both national and provincial assemblies.
The Supreme Court directed the Election Commission to implement the decision immediately, emphasizing that delays in implementing the court’s decision could have consequences.
Following this clarification from the Supreme Court, the Election Commission of Pakistan (ECP) responded that the matter of Pakistan Tehreek-e-Insaf's (PTI) intra-party elections is still under consideration, and no final decision has been made.
Sources referenced by the ECP indicated that it is not accurate to say that the ECP has recognized Barrister Gohar as PTI chairman.
According to the report, the statement said that the matter of PTI's intra-party elections is still under review, and no final decision has been reached.
Sources from the Election Commission clarified that it has always endeavored to resolve the matter as quickly as possible, while PTI repeatedly used delaying tactics.
The Election Commission sources emphasized that they are not responsible for any delays in implementing the Supreme Court's decision.
According to ECP sources, the Supreme Court delivered its brief decision on reserved seats on July 12, 2024. In response, the Election Commission filed its CMA within the legal timeframe on July 25, 2024. However, nearly two months later, on September 14, 2024, the Supreme Court issued an order on the CMA. Such treatment of constitutional institutions is deemed entirely inappropriate.
