Toshakhana Case: PTI Chairman's Sentence Suspended, Order to Keep Him in Jail in Official Secrets Act Case
Islamabad High Court suspends the sentence of PTI Chairman Imran Khan, who was arrested in the Toshakhana case, and orders his release, while a special court orders him to remain in jail in the Official Secrets Act case until August 30.
In the meantime, Judge Abulhasanat Mohammad Zulqarnain of the special court set up under the Official Secrets Act in Islamabad has sent a written order to the Superintendent of Attock Jail to send PTI Chairman Imran Khan to jail on judicial remand till August 30.
In a letter to Attock Jail authorities, it is said that the accused Imran Khan Niazi is on judicial remand in the case under the Official Secrets Act.
In the letter, Judge Abulhasanat Mohammad Zulqarnain said that the accused Imran Khan Niazi should be kept in jail and presented in court on August 30.
On the previous day, after hearing the former prime minister's request, a two-member bench comprising Chief Justice Islamabad High Court Amir Farooq and Justice Tariq Mahmood Jahangiri reserved the decision.
Announcing the decision on the PTI chairman's sentence suspension request, Chief Justice Amir Farooq said that the case was not included in the case list, so the copy of the decision would be provided shortly, only telling that the request has been approved.
Imran Khan had filed a petition in the Islamabad High Court on Tuesday, seeking a restraining order against his arrest in any other case.
He also requested an urgent hearing of the petition, while the court asked him to remove the objections.
However, Imran Khan is currently facing the biggest challenge in the cipher case. This case was filed against him after his arrest under the Official Secrets Act, and in this case, the former prime minister is accused of losing the diplomatic cipher.
According to court reporters, the judicial remand of Imran Khan has been approved in this case. That is, even after the suspension of his sentence and the grant of bail in the Toshakhana case, he will not be able to come out immediately. The accused remains in jail during judicial remand.
But the important thing is that the judicial remand period of Imran Khan is till Wednesday, August 30. He is expected to be produced in court on Wednesday.
Of course, there is also a possibility that his remand may be extended by putting him in jail.
After the suspension of Imran Khan's sentence on Tuesday, a letter from the judge of the special court set up under the Official Secrets Act came to light, which he wrote to the Superintendent of Attock Jail. It said that the accused Imran Khan Niazi is on judicial remand till August 30 and should be kept in judicial lockup till then and presented in court on August 30.
Summary
The cipher case is a major obstacle in Imran Khan's release. The case is based on allegations that he lost a diplomatic cipher, which is a serious offense under the Official Secrets Act. If Imran Khan is convicted in this case, he could face a long prison term.
The fact that Imran Khan's judicial remand is till August 30 means that he will remain in jail until at least that date. It is possible that his remand may be extended, which would further delay his release.
It remains to be seen how the case will proceed. If Imran Khan is able to prove his innocence, he could be released from jail. However, if he is convicted, he could face a lengthy prison sentence.
- Imran Khan was arrested in the Toshakhana case on August 5, 2022, after a trial court found him guilty of corruption. He was sentenced to three years in prison.
- Imran Khan challenged the conviction in the Islamabad High Court. The court heard arguments in the case on August 24 and 25, and reserved its decision.
- On August 29, the court suspended Imran Khan's sentence and ordered his release.
- However, Imran Khan remains on judicial remand in a separate case under the Official Secrets Act. He is scheduled to appear in court on August 30.
It is still unclear whether Imran Khan will be able to clear his name in the cipher case. If he is convicted, it could have a significant impact on his political career.
